The Uyghur Forced Labor Prevention Act (UFLPA), which took effect in June 2022, has seen its enforcement scope steadily expand as the U.S. government intensifies efforts to combat forced labor, particularly in China’s Xinjiang region. Recent developments have added seafood, aluminum products, and footwear to the list of industries subject to heightened scrutiny under the UFLPA. The recent action by DHS specifically names three companies that have been added to the prohibited entities list. Shandong Meijia Group Co., Ltd. a processor and exporter of seafood products, Dongguan Oasis Shoes Co., Ltd. a manufacture of footwear and footwear materials, and Xinjiang Shenhuo Coal and Electricity Co., Ltd. a producer of electrolytic aluminum, graphite carbon, and prebaked anodes. This expansion reflects growing concerns about the prevalence of forced labor in these sectors, particularly in supply chains that are difficult to trace and monitor.

The inclusion of seafood on the UFLPA enforcement list highlights the significant risks of forced labor in the global fishing industry. U.S. authorities have increasingly focused on seafood imports, which are often linked to exploitative labor practices aboard fishing vessels and in processing facilities. The complex nature of seafood supply chains, involving multiple intermediaries across different countries, makes it challenging to ensure that products are free from forced labor.

Similarly, the addition of aluminum products and footwear to the UFLPA enforcement list underscores the broader reach of forced labor concerns in global manufacturing. Aluminum production, especially in regions with significant energy resources like Xinjiang, has been flagged for forced labor involvement, particularly in the mining and refining stages. The footwear industry, with its extensive reliance on low-cost labor in manufacturing hubs, also faces significant risks of forced labor, particularly in facilities linked to Xinjiang. By targeting these industries, the U.S. is sending a clear message that forced labor will not be tolerated in any sector, and companies must take proactive steps to ensure their products are ethically sourced.
